1. Definitions & Governing Agreement
1.1. “Aourir Waves,” “we,” “us,” or “our” refers to the retreat business operating at [Your Property Address], Morocco.
1.2. “Guest,” “you,” or “your” refers to the person making the booking and all individuals included within that booking.
1.3. “Retreat” or “Package” refers to any bundled accommodation, surf instruction, activities, therapy sessions, and meals sold by Aourir Waves, including but not limited to the “Beyond the Break” workshops.
1.4. “Activities” refers to all events included or optional within a Retreat, including surfing, swimming, breathwork, group therapy, yoga, qigong, hiking, quad biking, excursions, and use of facilities.
1.5. This document constitutes the entire agreement. By making a booking, you confirm you have read, understood, and irrevocably agree to be bound by these Terms.
2. Booking, Pricing, & Payment
2.1. Booking Process: A booking is confirmed only upon our written confirmation sent after receipt of the required deposit.
2.2. Pricing: All prices are listed in Euros (€) and include VAT where applicable. We reserve the right to correct pricing errors.
2.3. Deposit: A non-refundable deposit of 40% of the total Retreat price is required to secure your booking.
2.4. Final Balance: The full remaining balance is due 60 days prior to your scheduled arrival date. For bookings made within 60 days of arrival, full payment is required immediately.
2.5. Payment Failure: If the final balance is not paid by the due date, we reserve the right to treat the booking as cancelled by you, and the deposit will be forfeited. Your space may be released for resale.
2.6. Payment Methods: Payments are accepted via bank transfer or designated online platforms. All transaction fees are the Guest’s responsibility.
3. Cancellations & Changes by Guest
3.1. Cancellation Must Be In Writing: All cancellations are only effective upon receipt of a written email from the lead guest to our official booking address.
3.2. Cancellation Fees: Due to advance commitments to practitioners and blocked calendars, the following fees apply: * 60 days or more before arrival: Loss of 40% deposit.
* 30 to 59 days before arrival: 50% of the total Retreat price is forfeited.
* Less than 30 days before arrival, or No-Show: 100% of the total Retreat price is forfeited.
* Early Departure: No refund is provided for any unused portion of the Retreat. 3.3. Guest-Requested Changes: * Date/Package Changes (>60 days prior): Subject to availability and a €75 administrative fee, plus any price difference.
* Date/Package Changes (<60 days prior): Treated as a cancellation (per clause 3.2) and a new booking.
* Guest Substitution: Permitted only if requested ≥ 45 days prior to arrival, subject to a €100 administrative fee and the new guest accepting all Terms in full.
4. Changes or Cancellation by Aourir Waves
4.1. Our Right to Cancel: We reserve the right to cancel a Retreat for operational reasons (e.g., underbooking). In this event, you will be offered a choice of a full refund or transfer to an alternative date.
4.2. Changes to Services: We may make minor changes to the Retreat program, accommodation, instructors, or meals. For a significant change (e.g., change of primary venue), you may choose to accept, transfer, or receive a full refund.
4.3. Force Majeure: We are not liable for failure to perform due to events beyond our reasonable control, including but not limited to: war, threat of war, civil unrest, terrorism, industrial action, natural disaster, fire, epidemic/pandemic, or government travel restrictions (“Force Majeure Event”).
* In a Force Majeure Event, our obligation is to provide a credit note for all monies paid, valid for a future Retreat within 24 months.
* No cash refunds will be provided under any Force Majeure circumstances.
* We are not liable for any incidental costs you incur (e.g., flights, visas, other travel).
5. Mandatory Travel Insurance
5.1. Requirement: It is a mandatory condition of your booking that you obtain comprehensive travel insurance for all participants.
5.2. Coverage Required: Your policy must explicitly cover, at a minimum:
* Trip cancellation, interruption, and curtailment.
* Medical expenses and emergency evacuation/repatriation (minimum €200,000 recommended).
* Personal accident, injury, and death.
* Personal liability.
* Loss/theft of personal belongings.
* All adventurous activities included in your package (e.g., surfing, quad biking, hiking).
* Participation in wellness/retreat programs (including group therapy and breathwork). 5.3. Proof of Insurance: You must provide proof of valid insurance with the required coverage upon our request, which may be made at any time before or during your stay. We bear no financial responsibility for any incident, loss, or injury that should be covered by your insurance policy.
6. Assumption of Risk, Release of Liability & Indemnity
THIS CLAUSE IS OF CRITICAL IMPORTANCE. PLEASE READ IT CAREFULLY.
6.1. Acknowledgment of Inherent Risks: You understand and accept that your participation in the Retreat and its Activities involves inherent risks and dangers that can lead to serious personal injury, permanent disability, death, emotional distress, and loss or damage to personal property. These risks include, but are not limited to:
* Surf & Ocean: Drowning, powerful waves, rip currents, collisions with boards or other surfers, marine life interactions, hypothermia.
* Land & Adventure: Falls during hiking or bouldering, quad biking/ATV accidents, injuries during physical training or movement sessions.
* Therapeutic & Emotional: Emotional or psychological discomfort, distress, or triggering arising from guided therapy, breathwork, or group sharing sessions.
* General: Slips, trips, falls on the property, food allergies or illness, travel in vehicles, illness in a remote location.
6.2. Express Assumption of Risk: You voluntarily and expressly assume ALL such risks, both known and unknown.
6.3. Release & Waiver of Liability: In consideration for being permitted to participate, you, for yourself, your heirs, executors, and administrators, hereby:
* RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Aourir Waves, its owners, directors, employees, guides, independent contractors, and agents (collectively, “Releasees”) from any and all liability, claims, demands, or causes of action for personal injury, illness, death, property damage, or loss of any kind arising from your participation in the Retreat, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.
6.4. Indemnity & Hold Harmless: You further agree to INDEMNIFY AND HOLD HARMLESS the Releasees from any loss, liability, damage, or cost (including legal fees) they may incur due to your participation in the Retreat or any violation of these Terms, whether caused by your negligence, wilful act, or omission.
7. Guest Responsibilities, Health & Conduct
7.1. Health Declaration: You declare that you and all members of your party are in good physical and mental health, and are sufficiently fit and capable to participate in a demanding retreat program. You must disclose in writing, at the time of booking, any pre-existing medical or psychological conditions, injuries, allergies, or dietary restrictions. Failure to do so may result in exclusion from Activities without refund.
7.2. Safety Compliance: You must listen to and follow all instructions and safety briefings provided by our staff, guides, surf instructors, and therapists. Disregard for safety rules may result in immediate exclusion from an Activity or the entire Retreat without refund.
7.3. Code of Conduct: You agree to act with respect towards other guests, our staff, the local community, and the environment. Aourir Waves maintains a zero-tolerance policy towards:
* Verbal abuse, harassment, discrimination, or violence.
* Illegal activities and products
* Disruptive behaviour that impacts the enjoyment or safety of others.
* Theft or vandalism.
Breach of this code will result in immediate expulsion from the Retreat and property without refund.
7.4. Damage & Loss: You are financially responsible for any damage to, loss of, or excessive soiling of Aourir Waves property, your accommodation, or equipment (e.g., surfboards, wetsuits, yoga mats) caused by negligence or wilful act. Charges will be levied at full replacement or repair cost.
8. Limitation of Aourir Waves' Responsibilities & Disclaimers
Aourir Waves provides unique retreats inspired by our deep connection to the ocean, Moroccan heritage, and transformative personal journeys. We operate in a natural, adventurous environment and work with independent practitioners. Therefore, our responsibilities are limited as follows:
8.1. No Liability for Specified Circumstances: Aourir Waves does not accept liability or offer refunds in the following circumstances:
* For any consequence resulting from the Guest's failure to follow safety instructions, staff guidance, or the Code of Conduct (Section 7).
* For defects, failures, or changes in service delivery caused by the actions or omissions of third-party providers (e.g., independent surf instructors, therapists, transport companies).
* For any incident, injury, loss, or damage that occurs before or after scheduled retreat hours, or during any period when the guest is not under the direct supervision of Aourir Waves staff.
* For the unpredictable and uncontrollable natural conditions of the ocean and weather, as per Section 8.2.
8.2. Surf & Weather Conditions: We do not guarantee specific surf, weather, or sea conditions. The Retreat leader and surf guides have sole discretion to cancel, modify, or relocate any Activity based on safety assessments. A reasonable alternative will be provided where possible. No refunds or compensation are given for changes, cancellations, or poor conditions due to weather or ocean state, or if you choose not to participate in a provided alternative.
8.3. Service Character & Additional Requests: Our retreats offer a standard level of service aligned with their adventurous and communal spirit. Requests for additional services that fall outside the explicitly included package (e.g., private transfers outside scheduled times, specialized deep-cleaning, complex dietary preparations beyond disclosed allergies) are subject to availability and may incur an additional fee, to be confirmed in writing by our management in advance.
8.4. Personal Belongings: All personal belongings, including vehicles, are the sole responsibility of the guest at all times. We provide lockers for valuables but are not liable for loss or theft.
8.5. Travel Documentation: You are solely responsible for obtaining and carrying a valid passport, any required visas, and for complying with all Moroccan entry, health, and customs regulations. Non-compliance does not warrant a refund.
8.6. Check-in/Check-out: Check-in is from 15:00. Check-out is by 11:00. Early or late requests are subject to availability and may incur a fee.
8.7. Transfers: Complimentary scheduled group transfers are provided only from Agadir (AGA) airport or Agadir main bus station on the designated arrival/departure days. Transfers outside these times or from other locations can be arranged at an additional cost.
8.8. Use of Images: We may take photographs and video during the Retreat for use in marketing. By booking, you grant us a royalty-free, perpetual license to use such media. If you object, you must inform us in writing prior to arrival.
9. General Provisions
9.1. Governing Law & Jurisdiction: This agreement is governed by the laws of the Kingdom of Morocco. Any disputes shall be subject to the exclusive jurisdiction of the courts of Agadir, Morocco.
9.2. Severability: If any provision of these Terms is found invalid or unenforceable, the remainder shall remain in full force.
9.3. Privacy: We process your personal data in accordance with our Privacy Policy, available on our website.
